PRIVACY POLICY

1. This informative note has been prepared by Il Boteh SrL with registered office in Genoa, Corso Europa 424 (“Company”) pursuant to Article 13 of Legislative Decree No. 196 of June 30, 2003 on the protection of personal data (“Privacy Code”), in order to describe the methods of management of the site at the address (“the Site”) and the services made available through the Site by the same Company (“the Services”) in relation to the processing of personal data of users who consult the Site and/or use the Services (“the Users”).

COLLECTION OF PERSONAL DATA

Community Registration

2. In certain sections of the Site, i.e. when using the Services and Information, the User is offered the opportunity to register by entering a special area of the Site and thus benefit from a whole series of exclusive advantages reserved for registered Users.
All this is managed by the Company through the newsletter, a periodic communication sent, by e-mail, to the e-mail address indicated by the User, through which registered Users will be informed of exclusive initiatives that the Company will make available to its registered Users, such as prize contests, exclusive services, blogs, forums, discussion areas, invitations etc. (“Newsletter”). The Newsletter may also contain advertising banners, advertisements and offers from both the Company and third parties.
Upon registration, the User will be asked to enter personal data, some of which - expressly identified as such from time to time - will be mandatory and essential to confer for the purpose of registration (e.g. the e-mail address at which to receive Newsletters). Other data may or may not be provided, at the User's discretion, and failure to provide them is in no way detrimental to the purposes of registration, but may make it impossible for the User to participate in certain contests or initiatives, or otherwise allow him or her only partial use of the Services. Where required, Users who do not provide their cell phone number or consent thereto will, for example, not be able to be contacted via SMS to be invited to previews or events, and will not be able to participate in those contests, games, surveys conducted through SMS, MMS or other mobile messaging. The same will also not be able to receive ringtones, logos, wallpapers and other multimedia content intended for cell phones, nor commercial offers, discounts, info on promotions from the Company and/or its partners, conveyed through mobile phone networks and terminals.

Site navigation and cookies

3. The Site's server, including through cookies, automatically records certain information about the User's computer and navigation, such as: the name of his/her Internet access provider, site of origin, pages visited, date and duration of the visit, etc. This information will be recorded anonymously, and used only to allow access to the Site and/or enjoyment of certain Services, and then deleted, or used in aggregate form for statistical purposes of the Site and to monitor, again in aggregate and never individually, which pages of the Site and which Services are most liked by Users.
Opinions and preferences expressed by the User as part of a contest, survey or other similar initiative, where requested, are also processed by the Company only in aggregate form and never individually, nor for User profiling purposes.

Third party data

4. In some areas of the Site the User may be provided with the opportunity to send articles, messages, gadgets or gifts to third parties; in such sections the User may be asked to provide the address and/or name of the recipient. The Company uses this data only to fulfill the User's request, and then immediately deletes it from its database, without making any further use of it.

Cookies

5. The cookies used are text files that the Site transfers to the User's computer in order to facilitate navigation. Thanks to cookies, it can be facilitated the recognition of the registered User by the Site, avoiding, for example, the need to carry out their own authentication (by means of “log-in” and “password”) at each access to the Site. In addition, cookies may allow Users to personalize their use of the Site by saving their preferred settings.
As highlighted above, cookies also record certain information about the User's browsing; however, this information is not recorded in an individual form, and therefore does not interfere with the privacy and confidentiality of Users.
Each User has the option to disable cookies through the software used to browse the Internet (so-called “browser”). Many browsers are set to accept cookies in the absence of different instructions from the User. The Company invites Users to check their browser settings with reference to cookies, and to adjust them according to their preferences, bearing in mind, however, that in order to take advantage of some Services it may be necessary to enable the reception of cookies (in such cases the User will be duly informed).

METHODS AND PURPOSES OF PROCESSING

Storage of and access to data

6. In its capacity as data controller, the Company proceeds, directly or through any managers indicated on the Site, to save the personal data of the Users in special servers and to carry out all other processing operations through the personnel - of the controller and the manager - appointed for this purpose in the capacity of appointee, or through any external appointees during maintenance operations. The database is accessible only by the authorized parties through ways that guarantee its protection and confidentiality, thanks to the adoption of security measures prepared to prevent data loss, illegal or incorrect use and unauthorized access. The data are kept for the time strictly necessary to give effect to those processing operations put in place in relation to the data of each User, according to his choices, preferences and indications.

Processing in general

7. The Company uses the data of Users in accordance with the choices that the User has freely exercised through his or her consent, at the time of their collection or subsequently, as well as to comply with obligations required by law, regulation or an EU directive. Some data are used without requiring consent - pursuant to Article 24 of the Privacy Code - to fulfill a specific request made by the User and within the limits of the request itself.

 

Processing operations subject to consent, communication and dissemination of data

8. Only in the presence of an express authorization from the User, the Company proceeds to use his data for the same activities referred to in the preceding paragraph with the aid of automated tools without the intervention of an operator and/or for the other purposes from time to time authorized by the User. Similarly, only with the express consent of the User may the Company share or communicate his/her data to its business partners - from time to time expressly indicated or listed on the Site - so that they may proceed, in their capacity as data controllers or managers, to separate processing having the same modalities and the same limits as those authorized to the Company. The data of Users, except with their prior consent, are never disseminated, with the exception of those that the User voluntarily makes available on any publicly accessible common areas of the Site. The Company invites Users not to provide their personal data within the publicly accessible common areas of the Site, reserving the right to delete such data or make them anonymous if they are sensitive data as defined in Article 4 paragraph 1 letter d) of the Privacy Code. Finally, the data may be communicated to public authorities in the presence of a legitimate order given by them.

 

USER RIGHTS

9. In accordance with the provisions of Article 7 of the Privacy Code, the Company grants the User the right at any time to change his preferences regarding the processing of personal data concerning him, and to obtain confirmation of the existence or non-existence of such data, as well as to know their origin, content, purposes and methods of processing, to request their updating, rectification, integration, or to request the cancellation or blocking of those processed in violation of the law.
The User has, moreover, the right to object to the processing of his data, as well as to request at any time the cessation of the processing for the purposes of market research, sending advertising material, direct sales, commercial communication.

UNDERAGE USERS

10. The Company is aware that the Site and the Services may be of interest to a minor audience .Regarding the collection and processing of personal data, the Company does not carry out any operation of processing personal data of minors without the consent of their parents. Therefore, registration is only allowed for Users who are of age or Users who are 14 years of age or older and have the consent of their parents.

The Company, moreover, also encourages the registration of the parents of registered Users who are minors: in this way, parents have the opportunity to use the Services and to always be aware of the initiatives that the Company makes available to their children, and thus to check their compliance with their own expectations and educational models and paths.

12. Due to the global nature of the Company's activities, data may be transferred to computer servers located in other countries within the European Community. Any transfer of data shall be in accordance with the Data Protection Act of the United Kingdom and the European Union.

CHANGES TO THIS POLICY

13. Without prejudice to the fact that the Company in any case does not carry out processing operations other than those expressly authorized and/or requested by each User, this policy may be subject to amendments to comply with new legal provisions or the Company's changed data processing policies.

Any updated version of this policy will be made available on the Site in the dedicated section: the Company therefore invites all Users to periodically consult the Site to be always informed of the latest version uploaded.
